Fees and Credits Policy

Welcome to Rent.com! If you are the owner or manager of a rental property with 20 or more units, you must register under one of the following programs: Pay-Per-Lease, EasyPay or Hybrid.

If you are the owner or manager of a rental property with fewer than 20 units, you must register under the Pay-Per-Listing Program.

This Fees and Credits Policy is incorporated into and is made a part of the Advertising Agreement entered into between you and Rent.com. Certain capitalized terms used but not defined in this policy are defined in your Advertising Agreement.

Pay-Per-Lease, EasyPay and Hybrid Programs

Reported Lease. Under each of these programs, you will pay to Rent.com a "Success Fee" (in an amount specified in your Advertising Agreement) for each "Reported Lease" that you receive. A Reported Lease occurs when a renter: (a) finds the Property advertised on the www.rent.com website (the "Website"), whether accessed through a computer, mobile device, or otherwise; (b) enters into a lease for a unit in the Property; (c) moves into the unit; and (d) reports or causes the lease to be reported on his behalf to Rent.com. (Rent.com incents renters to report their lease by offering a $100 Reward Card for doing so. See Reward Card Policy.)

Please note: Because guest cards are inherently inaccurate as renters often confuse or forget advertising referral sources, guest cards shall not be determinative of a Reported Lease or of whether a renter found a property on Rent.com. You agree that a renter does not have to list Rent.com as a referral source in order for you to be obligated for a success fee. We may provide evidence from other sources, including our internal tracking software, indicating that the renter found the property on Rent.com.

Fees.

Rent.com will invoice you for all Success Fees and monthly Service Fees (collectively, the "Fees"). You will be invoiced for your Service Fee on a monthly basis on or around the monthly anniversary of the Effective Date of your Advertising Agreement. You will be invoiced for any Success Fees each time a Reported Lease is generated. Once a Reported Lease is reported to us by the renter and the renter moves in, we will notify you of the details of the Reported Lease via email. Unless you dispute that Reported Lease within seven (7) days of the email notification, we will send an invoice for that Reported Lease. On a monthly basis, we will send you a summary of your Fees for the month.

Please note the following as it relates to Success Fees, Reported Leases, product changes and monthly invoices:

All invoiced amounts are due upon receipt and must be paid within thirty (30) days or interest will be charged at a rate of 1.5% per month, or the highest rate allowed by applicable law, whichever is lower. You will also have the option to request additional related services, as described below, for an additional charge that will be subject to the same payment terms as the Fees.

Termination. You may terminate your Advertising Agreement upon thirty (30) days prior written notice to us as set forth in your Advertising Agreement. On the 30th day following receipt of such notice, your listing will be terminated ("Listing Termination Date"). Following the Listing Termination Date, you agree to pay (a) the Service Fee for the month in which the Listing Termination Date occurs, and (b) the Success Fee for any Reported Leases during the 60-day period following such Listing Termination Date.

In the event the Property undergoes a change in management or ownership, you agree to notify us within ten (10) days after such management change. You will remain liable for the Fees after such management change or sale unless you provide acceptable evidence that the new manager or owner has assumed the liability for the Fees.

Early Termination Credit. If within ninety (90) days after the start of the term of a Reported Lease, the renter breaks the lease or is evicted for any reason (unless the entire lease term is less than 90 days), the Success Fee will be reduced to $175, and the excess between the Success Fee paid by the Property for such Reported Lease and the reduced Success Fee will be credited toward the next Success Fees coming due. Otherwise, Rent.com will have no obligation to credit or return any portion of a Success Fee.

Additional Services. If you like, you may also upgrade your listing by participating in Rent.com's Precision-Targeted Email Program, Featured Listing Program or VIP Listing Program. Reward Card. Renters who sign a lease with you for a Property registered under the Pay-Per-Lease, EasyPay or Hybrid Programs and then notify Rent.com that they have done so, may qualify to receive a $100 Reward Card or other valuable consideration from Rent.com and/or enter Rent.com's current promotion(s). The $100 Reward Card is not available for Properties registered under the Pay-Per-Listing Program. See Rent.com's Reward Card Policy. In the Rent.com Reward Card Policy, Rent.com directs renters to tell the Property they found the Property on Rent.com and encourages renters to write "Rent.com" as their source on guest cards and/or lease applications. This is one of many ways for the parties to confirm lease validity.

General. Rent.com reserves the right to change these fees at any time with thirty (30) days notice by posting those changes on the Rent.com Website and/or by email notification to you; however, no notice will be required for a reduction in fees. Rent.com may choose to temporarily change this Fees and Credits Policy and the fees for services provided for promotional events, and such changes are effective when Rent.com posts the temporary promotional event on the site. Rent.com maintains sole discretionary right to change some or all of its services at any time. In the event that Rent.com introduces a new service, the fees for that service are effective at the launch of the service. Users are responsible for paying all fees associated with using the Rent.com service and with using Rent.com's Website, and for all applicable taxes.

Pay-Per-Listing Program

Overview. Under the Pay-Per-Listing Program, you pay an up-front "Listing Fee" to activate your 30-day advertisement on www.Rent.com (the "Website"). The Listing Fee is $49 for properties with 1-10 units and $99 for properties with 11-19 units unless otherwise stated in your Advertising Agreement. In exchange for the Listing Fee, you will receive a minimum of 15 "Leads" during the "Activity Period", as described below.

Activity Period and Timing of Charges. The "Activity Period" is the period starting on the date your Property is first advertised on the Website (the "Activation Date") and ending on the date that is thirty (30) days later. If you have received at least 15 Leads during the Activity Period, your advertisement will become inactive at the end of the Activity Period. If you do not receive at least 15 Leads during that first 30 day period, the Activity Period will be extended, and your Property advertisement will remain active until the 60th day after the Activation Date. For example, if your Property advertisement is activated on May 10, the first Activity Period would be May 10 through June 9, but if you do not receive 15 Leads during that period, your Activity Period will be extended until July 9. The next Activity Period would start after reactivation of the advertisement. The Activity Period may not be the same for all Properties you advertise under the Pay-Per-Listing Program. Rent.com will charge your designated credit card for all Listing Fees when you register each Property. Any Listing Fees not paid when due will accrue interest at a rate of 1.5% per month or the highest rate allowed by applicable law, whichever is lower. You may replace your designated credit card by going to your Billing Information page.

Leads. A "Lead" is a communication from a Rent.com user to you through Rent.com via email or telephone. Multiple Leads from the same user will not be counted toward your 15 Lead minimum as long as the user is inquiring about the same Property. If the same user inquires about the same Property during a different Activity Period, that user's inquiry will constitute a new Lead toward the 15 Lead minimum in that Activity Period. In listing your Property, you must provide accurate and complete contact information so Lead(s) may be sent to you. Telephonic Leads that are not answered or that end less than eight (8) seconds after the call is connected will not be counted toward your 15 Lead minimum. Telephonic Leads answered in any mode, such as by a person or by answering machine will be counted toward your 15 Lead minimum. Given the nature of internet information and usage, occasionally, you may receive a Lead that does not contain accurate information. Although these Leads still count toward your 15 Lead minimum, we have priced our advertising service to reflect the occasional invalid lead.

Lead Management. You can view a summary of the Leads you have received by using Rent.com's Lead Responder tool. You are only allowed to use a Lead for the advertised Property. You may not divert Leads. Rent.com will use its internal controls to monitor your activity and if your use of Leads indicates that you are not using a Lead for the advertised Property, Rent.com may suspend or deactivate your advertisement.

Reactivation and Deactivation. You can reactivate or deactivate your Property advertisement at any time. To reactivate or deactivate a Property advertisement, click here. If you deactivate your Property advertisement, your Listing Fee will not be refunded. If you reactivate a Property before the end of its initial Activity Period, you will not be charged a Listing Fee for such reactivation.

Credit Card. When setting up your account on Rent.com, you will designate a credit card for Rent.com to use in charging you for the Listing Fees for using Rent.com. You may provide an alternative credit card at any time by going to your Billing Information page. You must be an authorized user of such credit card, and always keep a valid credit card on file with Rent.com. You hereby authorize Rent.com to charge your credit card for Listing Fees and other amounts you owe Rent.com. You understand that the amount charged will vary depending on the number of Properties you are advertising on the Website.

Reward Card. There is no charge for a renter to search for properties on Rent.com; however, renters must create a registration account. There is no charge for such registration. The $100 Reward Card is not available for Properties registered under the Pay-Per-Listing Program. See Rent.com's Reward Card Policy.
